(Marcy, NY - December 10, 2009) – On December 9, 2009, State Police in Marcy concluded a month long investigation into an incident that occurred on November 8, 2009 in the parking lot of the Rising Stars Sports Complex in Westmoreland, N.Y.

State Police were called on November 8, 2009 to a car/pedestrian motor vehicle accident at this location. At that time, 17 year-old, GARY POPIELARSKI II of 5673 Old Oneida Rd. Rome, N.Y. was located with head and internal injuries and was transported to St. Elizabeth’s Medical Center.

A subsequent investigation into this alleged motor vehicle accident showed that POPIELARSKI was in this parking lot to sell marijuana to two females. After the females received the marijuana they accelerated in the vehicle they were driving in an attempt to leave without paying for the marijuana. POPIELARSKI was injured when the girls left the parking lot and ran him over with their vehicle.

As a result of the investigation, GARY POPIELARSKI was arrested for Criminal Sale of Marijuana in the 4th Degree and providing a Punishable False Written Statement, both Misdemeanor charges. He was issued an appearance ticket returnable to the Town of Westmoreland Court.

  • LAUREN K. HEITZMANN , age 19 of 5459 Bushart Rd Oriskany, N.Y. was charged with Robbery in the Second Degree (Felony) , Assault in The Second Degree (Felony) and Reckless Endangerment 2nd (Misdemeanor).
  • VIVIAN A. GRICO-WOLAK , age 17 of Arthur St. Utica, N.Y. was charged with Robbery in the Second Degree (Felony) and Unlawful Possession of Marihuana (Violation).

Both HEITZMANN and GRICO-WOLAK were arraigned in the Town of Westmoreland Court and were committed to the Oneida County Jail in lieu of bail.
