Griffo: Don’t Destroy Merchandise, Help the Poor Instead

2012 2-9 Counterfeit Merchandise Processing Bill Press Event 002

Griffo pictured with State Police Officer Thomas E. Smoulcey, Jr. along with counterfeit goods earmarked for disposal.

(Marcy, NY – Feb. 9, 2012)  With the needs of people across the region hitting unprecedented levels, and government funding no longer being able to be spread as widely as in the past, Senator Joseph A. Griffo has proposed an innovative idea that can help needy individuals have access to clothes and boots.

Griffo highlighted the need for his legislation at the New York State Police substation in Marcy, where thousands upon thousands of dollars worth of usable clothing is scheduled to be destroyed because it was confiscated as “trademark counterfeit merchandise.”

“I fully support those laws that punish infringement of copyrights and trademarks,” Griffo said. “However, it bothers me deeply to see those who are in need, desperate for clothing while we are destroying serviceable items that could and should have a use.”

To allow this to happen, Griffo developed legislation under which, confiscated counterfeit items could actually help someone in need. Once the products have been altered to ensure that they are marked as imitation and found to be safe, they could be donated to nonprofit organizations who could then distribute the merchandise to persons living in poverty.

“To me this is an exercise in common sense,” Griffo said. “People who are desperate for warm shoes and coats are not going to care if the counterfeit brand name has been obliterated. They simply want to be warm. Many organizations work very hard to find clothes for those in need; it makes far more sense to use clothes that already exist to meet some of the most urgent needs and focus other resources on other needs. In practical terms, this would impact a small sliver of the stream of confiscated goods, but it will make a huge difference to the men and women we can help.”

Syracuse Man Arrested for Aggravated DWI on Thruway in Westmoreland

(Westmoreland, NY – Feb. 2012) On Friday Feb. 3 at approximately 4:13 p.m. Oneida County 911 Center began receiving multiple reports of an erratic red Dodge pick-up truck traveling east on Interstate 90 in the Town of Westmoreland.  The vehicle was reported as all over the road traveling from shoulder to shoulder.

State Police responded to the area, observed the vehicle and attempted to conduct a traffic stop.  A good samaritan driving a tractor trailer, who was not identified, assisted State Police by slowing down the traffic behind him and blocking both lanes. This rolling road block protected other innocent drivers from the danger.

When the driver of the Dodge finally pulled over at the Westmoreland toll plaza, he exited his vehicle while it was still in drive.  Troopers reacted quickly and removed the vehicle from the road before any injuries or property damage occurred.  The vehicle was later impounded.

The operator of the vehicle was identified as Anthony M. Imbesi, owner of the Market Diner in Syracuse.  Troopers interviewed Imbesi and discovered he was highly intoxicated, combative and verbally abusive. Imbesi was arrested and transported to SP Syracuse station for processing.  There, he continued his barrage of racial slurs and uncooperative behavior.  Imbesi’s blood alcohol level was obtained and revealed at three times the legal limit, a Felony in NY State.

Imbesi was charged with Felony Aggravated DWI, Felony DWI due to a previous DWI conviction, Failure to Obey a Police Officer, Open Alcohol Container in a Motor Vehicle as well as multiple Vehicle and Traffic Law Violations.  Further charges for Aggravated Harassment are pending at this time.

Imbesi was arraigned in the Town of Verona Court and released on $10,000 bail.  He is scheduled to appear in the Town of Westmoreland Court on Feb. 8 at 3 p.m.
