Traffic Stop Leads To DWI Arrest in Vernon

(Vernon, NY – Sept. 28, 2011) Oneida-based state police charged a Whitesboro man with Driving while Intoxicated following a traffic stop on Marble Road in the Town of Vernon at 11:30 p.m. Saturday evening Sept. 24.

Trooper Mark Buzzard was patrolling northbound on Peterboro Road in Vernon when he observed a 2003 Mitsubishi Eclipse travelling southbound on Peterboro Road with one headlight out.  As Trooper Buzzard was turning his patrol vehicle around to stop the vehicle, the Eclipse attempted to evade the trooper by accelerating rapidly and turning left onto Marble Road.

Trooper Buzzard was able to determine the speed of the Eclipse at 75 miles per hour utilizing radar as he attempted to catch up to the Eclipse.  The Eclipse pulled into a driveway on Marble Road and turned off its lights, but Trooper Buzzard observed the vehicle parked in the driveway.

Trooper Buzzard approached the vehicle and interviewed the operator, who was identified as Andrew M. Mitsler, 24, of Wilcox Road in Whitesboro, and observed that Mitsler was under the influence of alcohol.  Following field sobriety testing, Mitsler was arrested for DWI and transported to the SP Oneida barracks for processing.

A breath test determined that Mitsler’s blood alcohol content was .11 percent.

While in custody, Mitsler was found to be in possession of a pipe and metal grinder containing marijuana. A DMV check revealed that Mitsler did not possess a valid New York State drivers license.

Mitsler was charged with DWI, Driving with a BAC over .08 percent, Speeding, Unlicensed Operator, Inadequate Headlights and Unlawful Possession of Marijuana and is scheduled to appear in the Town of Vernon Court on Oct. 19, 2011.
